    (from the last thread)

RE: Gorsuch & the violent crime ruling yesterday:

The ruling was NOT a sharp departure from previous rulings at all. The Court has been whittling down the statute in question* for a long time.

The problem is, Congress ‘enumerated’ SOME specific “crimes of violence” in the statute, & those enumerated crimes of violence pass legal muster. However, Congress also included a separate ‘catchall provision,’ in case they unintentionally omitted some atrocity in the enumerated offenses. It is that nebulous ‘catchall’ provision that the Court ruled void for vagueness.

Imo, what the Court did yesterday is not that big a deal & certainly not unexpected. It’s been trending that way for years. However, a lot of violent federal offenders WILL get their sentences reduced as a result. In its opinion, the Court invited Congress to fix the law, i.e., to remedy the vagueness problem.

  5. DW says:

With the top three dems for 2020 Biden, Sanders, and Warren (no one else above 7%), the Dems seem poised to take Trump’s age off the table.

    Ages as of January 2021:

    Biden 78
    Sanders 79
    Warren 71

Of course Trump will be 74. But the problem for Dems is the fact that Biden and Sanders are currently the two front-runners, and of the three, Warren would be the least of the three likely to win a general election. She has all the negatives of Hillary, plus the native American scandal, plus even greater regional identity (hard-core north-east leftist elitist in the mold of John Kerry).

It is astounding to me that of the 25 Dem candidates, they are somehow managing to help Trump as much as possible by supporting these three instead of a fresh face from somewhere in the American heartland who could resonate better with voters.

Socialist radical fossil from VT, Socialist hypocrite snob from MA, and worn-out gaffe machine from DE all plays right into Trump’s hands.

I am not saying Trump is going to win, but wow, Dems are sure helping him.

  6. jason says:

Drudge has some pessimistic headlines on consumer sentiment and the economy, including slumping home sales.

Trump is playing with fire with his asinine tariffs and it is beginning to catch up with him. The market hates uncertainty and it seems like the market and businesses are taking seriously the long term damage Trump’s trade wars will do to the economy.

The one thing he has going for him is the economy, but if that tanks he is toast.

Trump should take what he can get and declare victory and end the trade wars. Of course, the Chinese are reading the same headlines.

  7. DW says:

Bernie Sanders of course wants to steal your investments to pay off the student loan debts.

The fact that such an idea can even be spoken into a microphone without it being an immediate disqualification for office shows how far gone the USA is.

  8. DW says:

He might be toast even with a good economy Jason, look at 2018–the good economy did nothing to help the house GOP.

  9. Victrc says:

Ive got four comments waiting in the filter, checking to see if its me or the content.

  10. Paul says:

    5. I agree. As a Democrat, I think any of the top three would be a mistake. I personally would go for Gov. Bullock who isn’t even making it to the debate.

  11. DW says:

10 – yep with Biden, Warren and Sanders it seems the strategy is to sure up New Hampshire, run up the score in the other New England states, NY, MD, DE, and the pacific coast states. But they already have all those states, and need to improve their standing in the mid-west.

  12. VictrC says:

I give up. The filter wins

    5 – I agree with your assessment

Biden is the front runner, and as it stands could beat Trump handily. Long time before the election. The economy is going to dictate how well Trump does, and as Jason stated, even then a good economy could not be enough if Trump continues to act like Trump. Agreed he needs to end the tariff war with China the same way he did with Mexico, come to some sort of “deal” where both sides can claim victory and move on.

The other dem candidates don’t have a chance though.

  13. mnw says:

Comments NEVER come out of the filter!

  14. Tina says:

Biden is plunging, if this poll is true.

Confirms that he had a terrible couple of weeks with the gaffes, touching, and small crowds/low energy.

  15. DW says:

And lets say as the Democrats get closer to actually voting, they collectively decide that Biden is too old, Sanders too radical, and Warren too out of touch, and they turn to the other 22 candidates for options, they will have the same problem the GOP had in 2016, where the support splinters and they will have someone ‘win’ early caucuses and primaries with 20% of the vote.

The best case scenario for Dems would be to dump Sanders, Biden, and Warren now, and early on get behind ONE solid candidate who is a fresh face. But that’s not possible because there are too many running.

  16. Victrc says:

DW. While it’s not impossible as other dark horse candidates have emerged and front runners faded in the past, I can’t see someone other than these three, Harris or potentially Mayor Pete coming out of this pack. The “ moderate” D Govs are not the right demographic and far too “ centrist” for the D primary voters.

  17. John says:

Goldman Sachs (Barron’s) has a chart just released that predicts Trump’s reelection despite Trump’s low approval numbers. The caveat is that he must stay just at 2.2% GDP or higher (down from 2.9%).

  18. NYCmike says:

-To think we got Alito instead of Harriet Miers……tell me again, if you are a CONSERVATIVE REPUBLICAN, how is it you don’t fight tooth and nail to get Trump re-elected, despite his shortcomings?

  21. jason says:

    5. I agree. As a Democrat, I think any of the top three would be a mistake. I personally would go for Gov. Bullock who isn’t even making it to the debate.”

Paul might be a troll moron, or is it moron troll, but he does show flashes of lucidity.

I think Bullock or Hickenlooper would be the strongest candidates against Trump, fortunately neither will be nominated.

Of the viable candidates, I still see Biden as the strongest.

  22. jason says:

Trump rape accuser E. Jean Carroll once said that “women love” the idea of a man with a “big club” dragging them into a cave.”

She does have a problem with dressing rooms, however.

  23. Wes says:

Remember when I said Trump needs to learn when to acknowledge an accusation and fight back?

    This would be that time.

Carroll lacks credibility but is making a serious charge Trump needs to squelch before it grows legs or leads to the bandwagon effect.

  24. jason says:

    Well, ok..

    E. Jean Carroll tells @Lawrence that she will not seek rape charges against Donald Trump because it would be “disrespectful” to women at the border “who are being raped around the clock”

  25. jason says:

I think the fact she only makes this charge in the book she wants to sell is enough for me to “squelch” it.

  26. jason says:

However, Trump’s comment that she is not his type was asinine.

  27. dblaikie says:

As I have said before I through trying to prove that a poll is bogus. You all can look at the internals and decide for yourself. However I would like to point out a data point from the past. On November 7, 2016 Emerson spewed out this headline, a real blast from the past:

If you don’t want to follow the link, here is the heart of their scientific poll, “Emerson predicts Clinton will win the swing states of Colorado, Florida, Michigan, Nevada, New Hampshire, North Carolina, Pennsylvania, Virginia and Wisconsin. Republican nominee Donald Trump is predicted to win Iowa and Ohio.”

So if you want to take this poll seriously. If you really believe it has nothing to do with helping hype tonight’s debate, go ahead and believe it.

I do agree with Jason that if the economy turns bad in the next 12 months Trump will lose. The President’s rhetoric aside tariffs are never positive for a economy. They may be an effective weapon in trade negotiations, but it is a weapon that comes with a price. China is paying a price for them and their economy is feeling the heat. At some point we are going to pay a price too.

What helps Trump, in my opinion, is that even though tariffs are going to drive prices up for many commodities, Trump’s energy policies are blunting that effect. At Costco yesterday in Columbia, South Carolina I paid $2.03 cents per gallon for gas — way down from the Obama years. My Utility bill is down from 3 years ago. Because of that these tariffs have not yet effected my standard of living. However if this trade war deepens that may change — that would be bad.

Several candidates are running against him, including the mayors of El Cajon and Temecula. Former congressman Issa appears to be interested in the seat. Hunter’s wife recent entered into a plea deal and testified against her husband. Hopefully Hunter resigns prior to the next election; perhaps it will be part of a plea deal.

Massachusetts man charged in crash that killed 7 motorcyclists

Volodymyr Zhukovskyy, 23, was arrested by Massachusetts State Police this morning on a fugitive from justice charge out of New Hampshire. That charge was dismissed this afternoon and he was turned over to N.H. law enforcement officials to face seven charges of negligent homicide in connection with Friday’s crash.

Donald W. Frank, public defender for Zhukovskyy, said the fatal crash “is tragic for the families involved … it’s tragic for his family, too.”

The crash in Randolph, N.H., Friday afternoon killed seven bikers from a Massachusetts veterans group. Killed in the crash were Jo-Ann and Edward Corr, both 58, of Lakeville, Michael Ferazzi, 62, of Contoocook, N.H., Albert Mazza, 59, of Lee, N.H., Desma Oakes, 42, of Concord, N.H., Aaron Perry, 45, of Farmington, N.H., and Daniel Pereira, 58, of Riverside, R.I.

All of them died as a result of blunt trauma, according to NH Deputy Attorney General Jane E. Young.

Several other riders were injured in the devastating wreck.

Zhukovskyy was driving a 2016 Dodge 2500 pickup towing a car-hauling trailer on Route 2 west about 6:30 p.m. Friday, authorities said, when it struck the group of motorcyclists heading east, authorities said.

The Massachusetts State Police said troopers also confiscated “wax packets containing a residue suspected of being heroin,” when they arrested Zhukovskyy this morning.

State police said the packets will be tested and additional charges may be filed if they test positive for heroin.

if you agree with reparations for slavery, raise your hand.

if you agree with reparations for lgbt oppression, raise your hand.

if you agree with forgiveness of student loans, raise your hand.

if you agree with healthcare for all (except for the white middle class), raise your hand.

if you agree with medicare for all (except for the white middle class), raise your hand.

if you agree with open borders, which we will describe as an electronic fence on the border, raise your hand.

if you agree with allowing undocumented workers to get drivers’ licenses and voting, raise your hand.

Too often women lie and exaggerate to garner sympathy and attention. I’ve known a number of females to lie about being abused and sexually assaulted.

These women should have their lives ruined when they lie about men in such a despicable manner. They deserve no leniency whatsoever because of the damage they inflict upon men.

That was the first part of your post, then you went on to say: “Trump needs to squelch before it grows legs or leads to the bandwagon effect.” My response was: “Caroll is a total ding dong. Watch her CNN interview. You really think she has credibility?”

You contracted yourself saying she had no credibility, then stating her story might grow legs and have a bandwagon effect unless Trump squelched it. I could only see that happening if her story appeared credible to the public. Do you still think Trump needs to move to squelch it or it will grow legs? Seems like the story is going nowhere, despite CNN’s attempt to publicize it.

  57. DW says:

“I think most people think of rape, it is a violent assault,” Cooper responded.

“I think most people think of rape as sexy,” Carroll said. “Think of the fantasies.””

Here are two excerpts from the Slate review of E. Jean Carroll’s book, which they fawn over.

“#MeToo allegations were always bound to become literature. They had to. The vehicle through which these incidents are reported would at some point adapt in order to address the formal impossibilities of the things it’s asked to do. Carroll’s essay is just such an expansion. What she produces, instead of a direct account of what was done and by whom, is an arch and experimental essay that keeps nodding at readerly expectations and deciding not to meet them.

    * * * *

Carroll is brutally candid about the crude “battle of the sexes” gamesmanship she took willing part in—like the pleasure she got from tracking the boys who wouldn’t call her and the boys she wouldn’t call. Carroll does not pretend she wasn’t sexually adventurous. She also does not hide that she remained in a bizarre situation with her boss in order to have the filet mignon, and clarifies that she saw this then as spunky rather than dangerous conduct”

  69. Sheeple, Jr. says:

There is always the chance it will backfire on all of us, as he will not have any reason to stay sane, since he will not be up for re-election. That is the system we live under, and in my opinion, it is the lesser evil to have an unpredictable President Trump vs the definite evil of a government-centered Democratic candidate win the office.

  77. NYCmike says:
